General terms and conditions of sale

Booking one of our stays implies the customer’s unreserved acceptance of the general terms and conditions listed below:

Article 1 – Scope of application

The present general terms and conditions of sale are agreed between: Lefrançaisalamaison – 11000 Carcassonne, registered with N°SIRET: 822836557 00014, which organises language learning holidays
And any physical or moral person, private individual or professional, public or private body desiring to use the services of Lefrançaisalamaison.

Article 2 – Object

These general terms and conditions aim at defining the conditions of sale between Lefrançaisalamaison and the customer from the time of booking and up to the start of the stay. The present terms apply to the services provided by Lefrançaisalamaison and subscribed to directly with our organisation by the customer, and exclude any other conditions, notably any laid out by the customer.

These conditions are legally inseparable from the booking contract.

Article 3 – Booking procedure

No booking is final until the customer has provided Lefrançaisalamaison with their booking form, filled, dated, signed and including a passport photo; nor until the mandatory deposit of 500 euros is paid.
The balance of the invoice must be paid in full by the customer on the day of arrival.
Minors must include in their booking application a parental consent form signed by both parents as well as a copy of their health insurance for the duration of their stay in France.
As soon as the full booking application and the deposit have been received, the customer is sent a booking confirmation via email.
Lefrançaisalamaison retains the right to cancel the booking if no payment is made on the first day of the stay.
Finally, by signing the booking form, the customer unreservedly agrees to the present terms and conditions of sale, as well as to the house rules to which they refer.

Article 4 – Terms specific to minors

All minors (children under 18 years old) welcomed by Lefrançaisalamaison must imperatively provide a consent form signed by their legal guardians upon booking.

Both parents will to be asked to sign a liability weaver for any outing outside of the lessons.

Article 5 – Withdrawal period

Once the booking is confirmed, the customer is granted a 14 day withdrawal period.

This starts as soon as the booking application and the 500 euros deposit have been received.

The customer shall notify his withdrawal in writing and with a recorded delivery letter.

Lefrançaisalamaison undertakes to reimburse in full any sums paid by the customer within 14 days after reception of the withdrawal notice. The refund will be made with the same payment method used at the time of booking, and to the person who made the original payment.

Article 6 – Payment modalities

Prices include all taxes ”TVA non applicable, article 293 B du CGI”

The invoice for the stay will be paid by either bank transfer (any bank fees must be borne by the customer) or cash against receipt.

Article 7 – Cancelation and postponement of the booking (outside withdrawal period)

  • Cancelation requested by the customer
  • Cancelation after the start of the stay

After the agreed date of arrival, no refunds will be made unless the early termination of the contract requested by the customer is justified by a legitimate and compelling reason (for instance, a serious health condition).

In the event of a serious health problem, the customer will provide Lefrançaisalamaison with a doctor’s certificate testifying of the incapacitating nature of the condition.

  • Cancelation and postponement initiated by Lefrançaisalamaison

In the event of a postponement of the booking, Lefrançaisalamaison will give the customer alternative dates of stay. If the customer agrees to them, the sum initially paid corresponding to the full payment of the cancelled booking is transferred to the invoice of the new booking and constitutes full payment.

If the customer does not agree to the new dates, the sum initially paid to Lefrançaisalamaison will be fully reimbursed.

In no cases can the cancelation or the postponement of a booking lead to the payment by Lefrançaisalamaison of damages, under any circumstances whatsoever.

Article 8 – Insurances

Health, accident and liability cover encompassing all the planned activities, as well as cancelation insurance (such as student holiday cover) must be organised by the customer.

Lefrançaisalamaison reminds its customers that individuals of foreign nationality are not covered by the French legislation in terms of social protection unless they have been residing in France for over three months.
Minors must provide a copy of their insurance certificate at the time of booking.

Article 9 – Responsibility

Lefrançaisalamaison undertakes to give its best to the performance of its services. However, its responsibility cannot be committed if its services have not been provided due to force majeure such as defined under existing French case law.

Article 10 – Applicable law and territorial jurisdiction

The present terms and conditions of sale are subject to French law. Any dispute arising from these terms and conditions falls within the exclusive jurisdiction of the courts of Carcassonne (Aude).
